Missed the ITR Filing Deadline and Cannot File Now? There May Still Be a Remedy

Missing an Income Tax Return deadline does not always mean that the opportunity to file the return is permanently lost. In eligible cases, a taxpayer may request the Income Tax Department to condone the delay and permit filing of the return after the normal statutory filing window has expired.
When Can Condonation of Delay Become Relevant?
This route is particularly relevant where the normal time available for filing a return has already expired and the taxpayer has a genuine reason for the delay. A condonation request may also arise where a taxpayer needs to claim a refund or carry forward certain losses but could not file the return within the prescribed time.
However, condonation is not automatic. The taxpayer must make an application explaining the circumstances that resulted in the delay, and the competent Income Tax Authority considers the request in accordance with the applicable provisions and CBDT instructions.
How Is It Different from an Updated Return?
A condonation request and an Updated Return (ITR-U) serve different purposes.
An Updated Return is subject to specific statutory conditions and generally cannot be used simply to increase a refund or declare a higher loss. Therefore, where a taxpayer has missed the filing deadline and the objective is, for example, to claim a legitimate refund, the appropriate remedy may need to be examined separately instead of assuming that ITR-U can solve every late-filing situation.
What Should Taxpayers Do?
Before making a condonation request, taxpayers should establish why the return was not filed on time, preserve documents supporting the reason for delay, determine the tax year involved and identify the financial consequence of not being permitted to file the return.
The important point is that missing a return-filing deadline should not automatically lead to abandoning a genuine tax claim. The available remedy depends on the facts, the relevant tax year and the nature of the claim.
